Hukuk Dairesi,<\/strong> kirac\u0131 ve ev sahipleri aras\u0131nda s\u0131k\u00e7a ya\u015fanan tahliye uyu\u015fmazl\u0131klar\u0131na ili\u015fkin uygulamaya y\u00f6n verecek iki ayr\u0131 kanun yarar\u0131na bozma karar\u0131 verdi. Kararlarda hem usule ili\u015fkin tebligat kurallar\u0131 hem de tahliye taahh\u00fcd\u00fcn\u00fcn hukuki ge\u00e7erlili\u011fi bak\u0131m\u0131ndan \u00f6nemli de\u011ferlendirmeler yap\u0131ld\u0131.<\/p>\n<p><strong>UYAP\u2019TA \u201cOKUNDU\u201d B\u0130LG\u0130S\u0130 TEBL\u0130GAT SAYILMAYACAK<\/strong><\/p>\n<p><strong>Yarg\u0131tay<\/strong>\u2019\u0131n ilk karar\u0131nda, <strong>Mersin 6. Sulh Hukuk Mahkemesi<\/strong>\u2019nin verdi\u011fi karar incelendi. \u0130lk derece mahkemesi, davac\u0131 vekilinin <strong>UYAP<\/strong> \u00fczerinden ara karar\u0131 okumas\u0131na ra\u011fmen har\u00e7 ve gider avans\u0131n\u0131 s\u00fcresinde yat\u0131rmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n a\u00e7\u0131lmam\u0131\u015f say\u0131lmas\u0131na karar vermi\u015fti.<\/p>\n<p><strong>Yarg\u0131tay<\/strong> ise <strong>UYAP<\/strong> evrak i\u015flem k\u00fct\u00fc\u011f\u00fcnde bir belgenin \u201c<strong>okundu<\/strong>\u201d olarak g\u00f6r\u00fcnmesinin, hukuken tebligat veya tefhim anlam\u0131na gelmeyece\u011fini vurgulad\u0131. Kararda, kesin s\u00fcrelerin ba\u015flayabilmesi i\u00e7in usul\u00fcne uygun fiziki veya elektronik tebligat\u0131n yap\u0131lmas\u0131n\u0131n zorunlu oldu\u011fu belirtildi.<\/p>\n<p>Bu gerek\u00e7eyle ilk derece mahkemesinin karar\u0131 kanun yarar\u0131na bozuldu.<\/p>\n<p><strong>YEN\u0130 K\u0130RA S\u00d6ZLE\u015eMES\u0130 TAHL\u0130YE TAAHH\u00dcD\u00dcN\u00dc GE\u00c7ERS\u0130Z KILAB\u0130L\u0130R<\/strong><\/p>\n<p><strong>Yarg\u0131tay<\/strong>\u2019\u0131n ikinci karar\u0131nda ise <strong>Manavgat 2. Sulh Hukuk Mahkemesi\u2019<\/strong>nin tahliye taahh\u00fcd\u00fcne dayal\u0131 tahliye karar\u0131 de\u011ferlendirildi.<\/p>\n<p>Dosyada, kirac\u0131 taraf\u0131ndan verilen tahliye taahh\u00fcd\u00fcnden sonra taraflar\u0131n yeni bir kira s\u00f6zle\u015fmesi imzalad\u0131\u011f\u0131 ve kira ili\u015fkisinin yenilendi\u011fi anla\u015f\u0131ld\u0131. Buna ra\u011fmen ilk derece mahkemesi tahliye karar\u0131 vermi\u015fti.<\/p>\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi,<\/strong> tahliye taahh\u00fcd\u00fcnden sonra imzalanan ve taraflarca ink\u00e2r edilmeyen yeni kira s\u00f6zle\u015fmesinin, \u00f6nceki tahliye taahh\u00fcd\u00fcn\u00fc h\u00fck\u00fcms\u00fcz hale getirebilece\u011fini belirtti.
